Terms and Conditions

Terms governing the use of ARIZN services, websites, communication systems, and messaging features.

Acceptance of Terms

These Terms and Conditions ("Terms") are an agreement between you and ARIZN LLC ("ARIZN," "we," "us," or "our"). By accessing our website, purchasing or using our services, creating an account, or otherwise using ARIZN systems, tools, or communication features, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

About ARIZN

ARIZN LLC provides business infrastructure, automation, communication tools, and AI-assisted operational services for small businesses. Our services may include missed-call text-back, conversational customer support, appointment reminders and confirmations, lead follow-up, estimate and quote follow-up, service notifications, review requests, referral requests, AI-assisted receptionist services, and integrations with customer communication platforms. ARIZN may send messages directly and may also provide technology that enables its business customers to communicate with their own customers.

Eligibility and Authorized Use

To use our services, you must have the legal capacity to enter into these Terms. If you use the services on behalf of a company or other organization, you represent that you are authorized to accept these Terms on its behalf, and "you" refers to that organization.

You may not use the services for any activity that is illegal, fraudulent, or abusive, or that violates the rights of any third party.

Accounts and Access

If you are given an account or access credentials, you are responsible for keeping them secure and for all activity that occurs under your account. You agree to:

  • Provide accurate and current information when creating or maintaining an account.
  • Protect your login credentials and not share them with unauthorized people.
  • Notify ARIZN promptly at pedro@arizn.co if you suspect unauthorized access to your account.

ARIZN may suspend or limit access that presents a security risk or shows signs of abuse.

Services

The features available to you may vary depending on your plan, agreement, or the integrations you use. You understand and agree that:

  • Some services depend on third-party providers and platforms.
  • Integrations with third-party platforms may change over time.
  • ARIZN may update, improve, or modify service features.
  • Customer-specific configurations, deliverables, or pricing may be governed by a separate agreement or Statement of Work, which controls in the event of a conflict with these Terms for that engagement.

SMS and Messaging Terms

Program name: ARIZN Business Communications.

By opting in to receive text messages from ARIZN Business Communications, you may receive transactional and conversational messages, including:

  • Responses to customer inquiries.
  • Missed-call follow-ups.
  • Appointment reminders and confirmations.
  • Service updates.
  • Lead and estimate follow-ups.
  • Account-related notifications.
  • Customer support messages.

Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of text messages. Reply HELP for help. Consent to receive SMS is not a condition of purchase. Opting out of SMS does not cancel other contractual obligations or services you have with ARIZN or with a business that serves you. Wireless carriers are not liable for delayed or undelivered messages.

Messages may be sent by ARIZN LLC directly, or by a business customer using ARIZN technology, in each case only where the recipient has provided consent or initiated the conversation. You must not use ARIZN systems to send messages to any person without appropriate consent. Business customers are responsible for maintaining records of consumer consent and for complying with the TCPA, CTIA guidelines, carrier rules, and other applicable laws and regulations.

SMS Consent

Consent to receive SMS messages is obtained separately from acceptance of these general Terms and is always voluntary. Any consent checkbox presented in ARIZN systems or forms must not be pre-checked.

Mobile opt-in data and SMS consent will not be sold or shared with third parties or affiliates for marketing or promotional purposes. This information may only be shared with vendors and service providers to the extent required to deliver the requested messaging service.

Customer Responsibilities

If you are a business customer of ARIZN, you agree to:

  • Only upload or submit contact data that you have the right to use.
  • Obtain appropriate consent before sending messages to your customers.
  • Honor STOP requests and other opt-out signals promptly.
  • Not send spam or unsolicited bulk messages.
  • Not use purchased, rented, or scraped contact lists.
  • Not send content prohibited by law, carrier rules, or these Terms.
  • Comply with applicable laws, regulations, and carrier requirements.
  • Keep your business information accurate and up to date.

Prohibited Use

You may not use ARIZN websites, services, or systems for:

  • Spam or unsolicited messaging.
  • Phishing or attempts to obtain credentials or sensitive data deceptively.
  • Fraud or misrepresentation.
  • Impersonation of any person or organization.
  • Harassment, threats, or abusive conduct.
  • Unlawful marketing practices.
  • Messaging to purchased contact lists.
  • Distributing malware or malicious code.
  • Deceptive or misleading messages.
  • Messages involving illegal goods or services.
  • Evasion of carrier filtering or messaging compliance systems.
  • Attempts to bypass or ignore opt-out requests.

Third-Party Services

Our services may depend on third-party providers, including telecommunications providers, hosting platforms, payment processors, AI providers, and integration platforms. ARIZN is not responsible for the availability, performance, or policies of third-party services, and your use of those services may be subject to their own terms.

Artificial Intelligence

Some ARIZN features use artificial intelligence to generate responses, summaries, or suggestions. AI-generated output may contain errors or inaccuracies. Important decisions should be reviewed by a human before being acted on. You remain responsible for the messages you send, the actions you take, and the decisions you make based on AI-assisted output.

Fees and Payment

Fees for ARIZN services are set out in your applicable plan, proposal, or agreement. Unless otherwise stated in writing:

  • Setup fees may be non-refundable once work has begun.
  • Recurring services may be billed monthly.
  • Services may be suspended for non-payment.
  • Third-party costs (such as carrier, platform, or usage fees) may be billed separately where applicable.

Intellectual Property

The ARIZN website, software, designs, and materials are owned by ARIZN LLC or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of ARIZN intellectual property to you.

You retain ownership of your own data, trademarks, and content. You grant ARIZN a limited license to process your data solely as needed to provide the services to you.

Privacy

Our collection and use of personal information is described in our Privacy Policy, available at https://arizn.co/privacy. By using our services, you acknowledge the practices described there.

Service Availability

ARIZN works to keep its services reliable, but does not guarantee uninterrupted operation, delivery of every message, permanent compatibility with third-party platforms, or the complete absence of errors. Maintenance, outages, carrier behavior, and third-party changes may affect the services from time to time.

Disclaimers

The services are provided on an "as available" basis. To the extent permitted by law, ARIZN disclaims warranties that the services will be error-free or uninterrupted. ARIZN does not guarantee any specific business results, such as increased leads, bookings, reviews, or revenue, from the use of its services. ARIZN is not a law firm and does not provide legal advice; you are responsible for your own compliance decisions.

Limitation of Liability

To the maximum extent permitted by law, ARIZN LLC will not be liable for indirect, incidental, special, or consequential damages arising out of or related to the services, including lost profits, lost business opportunities, or loss of data, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless ARIZN LLC from claims, damages, and reasonable costs arising from your unlawful use of the services, your violation of these Terms, messages you send without appropriate consent, or your violation of the rights of any third party.

Suspension and Termination

ARIZN may suspend or terminate access to the services, in whole or in part, in cases of:

  • Abuse of the services or of other users.
  • Security risk to ARIZN systems, customers, or third parties.
  • Non-payment of applicable fees.
  • Violation of applicable law.
  • Violation of these Terms.
  • Requirements imposed by a carrier, platform, or service provider.

Changes to These Terms

We may update these Terms from time to time as our services evolve. When we do, we will post the updated Terms on this page and revise the effective date above. Continued use of the services after an update means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
